Creditors’ Rights Practice Group
The Creditors’ Rights Practice Group of Barber & Bartz has been in place since 2001. The group has over 25 years of experience in representing local and national creditors and has expertise in both state court and bankruptcy court, including small claims actions, district court and superior court actions, motions for relief from stay, foreclosures, attachment proceedings, garnishment proceedings, replevins, receiverships, subrogation and supplemental proceedings. Our group serves a broad range of client needs, including assistance with occasional bad debt to high-volume collection services and representation in the bankruptcy forum.
In the area of collections, the group provides highly automated data processing capabilities that are easily integrated with our clients’ systems and allow them to out-source management of past due accounts receivable.
Our practitioners are fully versed in the Bankruptcy Code, Truth in Lending Act, Fair Debt Collection Practices Act and other consumer regulatory law and procedures that affect the creditors’ right of recovery of debtor loans.
